Canlegal Project Investigation Report
The Canlegal Project Investigation Report offers our client a comprehensive overview of a construction project throughout Canada. This report verifies the legal description of the job site, property ownership details through corporate searches, mortgage particulars, including any construction lien registrations, bonding information, and relevant contact details. Additionally, it encompasses all ministry reports and title searches related to the project, as well as public record information available from government sources.
Notice of Intent to Lien
This service notifies all parties with an interest in the project of the Canlegal client's intention to file a lien within a seven-day period. The intent to lien letter, delivered via courier and fax, elevates awareness and urgency among stakeholders, placing a legal obligation on all parties to withhold funds owed to the named party. Upon receipt and confirmation of the outstanding amounts, we will initiate a mediation process aimed at resolving these issues while preserving the client's lien rights. By leveraging the potential for construction lien registration, Canlegal mediators facilitate discussions to resolve outstanding or disputed payments, thereby maintaining business relationships and avoiding the need for lien preservation.
Construction Lien Registrations
CanLegal offers clients cost-effective risk assessment and lien registration services in Ontario. When a CanLegal client opts to preserve their lien rights, this service ensures comprehensive completion of the necessary steps to protect the claimant under provincial legislation. The lien preservation process begins with the CanLegal client providing pertinent information, including confirmation of project property, first and last dates of labor supply, property title searches, reviews of any related mortgages and liens, and the registered owner's address for intent to lien documents. The lien claim will be prepared on behalf of the CanLegal client, reviewed, and authorized for registration. All confirming documents will be forwarded to the CanLegal client, accompanied by a reporting letter for their records.
Land Title Search
Canada Legal Referral conducts thorough land title searches across Canada for clients supplying materials or labor to construction projects. These provincial ministry reports, available upon request, include the property PIN (Property Identification Number), title details listing the owners, a chronological account of ownership transfers, and all encumbrances, such as registered lien activity and mortgage details, including financial institutions and loan amounts.
Section 39 Letter (Ontario)
On behalf of the client, Canada Legal Referral will courier a Section 39 Letter under the new "Rights to Information." This letter mandates a response within 21 days from all parties with an interest in the project, detailing the current state of accounts among the construction parties. This transparency will clarify outstanding payments from the owner to the general contractor, as well as to subcontractors and suppliers, allowing the CLR client to better understand the status of their accounts.
Denunciation Letter Service
The Denunciation Letter Service from CanLegal enables clients in Quebec to preserve their construction lien rights as suppliers of materials or labor. Clients must notify relevant parties of their involvement in the construction project. The CanLegal denunciation service conducts a property title search to identify parties that must be notified under the act. A denunciation letter is then prepared and sent via courier or registered mail. This notification must be completed before any labor or materials are delivered to the project if the client intends to register a moveable hypotheque for payment assurance.
